Terms of Service
Last updated:
The short version
- You must be 18 or older.
- SwipeExam is for study only. It is not medical advice and it does not guarantee you will pass.
- Premium renews automatically until you cancel in the App Store or Google Play.
- The Service is provided “AS IS”, and our liability is capped.
- Disputes: talk to us first, then the courts in India. Your local consumer rights still apply.
Who these terms are between
These terms are an agreement between you and Sai Rakshith Muda, an individual developer (“we”, “us”), who runs SwipeExam. They cover the SwipeExam app and the website at swipeexam.com (together, the “Service”). By creating an account or using the Service you accept these terms and our Privacy Policy. If you do not accept them, please do not use the Service.
Who can use SwipeExam
You must be at least 18 years old. The app asks for your birth year and blocks anyone younger. By using the Service you confirm that you are 18 or older, that you are not in a country under a United States embargo, and that you are not on a United States list of restricted parties.
Educational use only. Not medical advice. No pass guarantee.
SwipeExam is a study tool. It is for education and exam practice only.
- Not medical advice. Nothing in the Service is medical, nursing, pharmacy or other professional advice. Never use it to decide how to care for a real patient. Follow your instructors, your employer’s policies, current clinical guidelines and the orders of licensed providers.
- No pass guarantee. We do not promise that you will pass any exam or earn any license. Results depend on many things we do not control.
- No affiliation. SwipeExam is not affiliated with or endorsed by NCSBN, NREMT, PTCB, ATI, Elsevier (HESI) or any other exam owner. See trademark notices.
We work hard to keep questions accurate and cite our sources, but health knowledge and exam blueprints change, and mistakes can happen. Check official exam sources for the current test plan. If you spot an error, use “Report an error” on the card or email support@swipeexam.com.
Your account
You can sign in with Apple, Google or an email link. Keep your sign-in secure, give us accurate information, and use one account per person. You are responsible for activity on your account. Tell us promptly if you think someone else has used it.
What you may and may not do
We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own study. In return you agree not to:
- copy, scrape, republish, sell or share the questions, rationales or other content, except for short quotations with a link back to us;
- use the content to train or test AI models;
- share your account or work around daily limits or paywalls;
- reverse engineer, probe or interfere with the app, our servers or our security;
- use bots, scripts or automated tools to access the Service;
- use the Service to cheat on, or help others cheat on, any exam;
- break the law or violate other people’s rights.
Our content, your feedback and third-party sources
The questions, rationales, design, code and branding are ours or our licensors’, and are protected by law. Our questions are original; they cite public sources that keep their own licenses, listed on the sources page. We make no claim over those sources.
If you send us feedback, such as an error report or a suggestion, you give us a free, permanent right to use it to improve the Service, without owing you anything or crediting you.
AI tutor
The AI tutor is optional and asks for your permission before first use. It works from our approved explanation and sources, but AI can be wrong or unclear. Treat its answers as study help, not as facts to rely on. See the Privacy Policy for what is sent to our AI provider. We may change, limit or pause the tutor at any time.
Subscriptions, free trials, renewal and cancellation
SwipeExam is free to start. Premium is an auto-renewing subscription sold through the Apple App Store or Google Play. We offer a quarterly plan and a monthly plan. The price, length and any free trial are shown in the app before you confirm, in your local currency, and they can differ by country.
- Billing. Payment is charged to your Apple Account or Google account when you confirm the purchase, or when a free trial ends.
- Free trial. If we offer one, it is for new subscribers and usually once per Apple Account or Google account. If you do not cancel at least 24 hours before the trial ends, it converts to a paid subscription. Any unused part of a trial is forfeited when you buy a subscription.
- Automatic renewal. Your subscription renews automatically for the same length at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- How to cancel. You manage and cancel in your store account, not in SwipeExam. On iPhone: Settings, tap your name, then Subscriptions. On Android: Google Play, tap your profile picture, Payments & subscriptions, then Subscriptions. The app also has a shortcut to your subscription settings. Cancellation takes effect at the end of the period you already paid for, and you keep Premium until then.
- Deleting is not canceling. Deleting the app or your SwipeExam account does not cancel a store subscription.
- Refunds. Apple and Google process refunds for store purchases, under their rules. Request one at reportaproblem.apple.com or through Google Play. We cannot refund store purchases ourselves. Where the law gives you a right to a refund or a cooling-off period, that right stays.
- Price changes. If a price changes, the store will tell you under its rules, and you can cancel before the new price applies.
- Restoring. Use “Restore purchases” in the app to recover Premium on a new device.
Apple and Google
If you get the app from the Apple App Store or Google Play, their terms also apply, including Apple’s standard license agreement for apps. Apple and Google are not parties to these terms. In this section “Apple” includes its subsidiaries.
- We, not Apple or Google, are responsible for the Service, for support and maintenance, and for any claims you have about it, including product liability, legal or regulatory compliance, consumer protection and privacy claims.
- If the app does not meet a warranty that applies to you, you can tell Apple, and Apple will refund the purchase price of the app to the extent the law requires. Apple has no other warranty duty for the app.
- We, not Apple, handle any third-party claim that the app infringes intellectual property.
- You must follow any third-party terms that apply when you use the app, such as your phone or data plan agreement.
- Apple and its subsidiaries are third-party beneficiaries of these terms for the App Store version of the app and can enforce them against you once you accept them.
Copyright complaints (DMCA)
If you believe something in the Service infringes your copyright, email support@swipeexam.com with the subject “Copyright notice”. Include: the work you say is infringed; where the material is in our Service; your name, address, phone and email; a statement that you believe in good faith the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We may remove material and may end the accounts of repeat infringers. If you think we removed something by mistake, you may send a counter-notice with the details the law requires.
Links and sources
The Service links to outside websites, such as the sources we cite. We do not control them and are not responsible for them. Citing a government or organization source does not mean that source endorses SwipeExam. In particular, the CDC does not endorse SwipeExam.
Ending your use
You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these terms, if we must by law, to protect the Service or other people, or if we stop offering the Service. If we end your access for a reason that is not connected to your conduct, we will help you ask the store for a refund of any prepaid, unused subscription time. Sections that by their nature should survive, such as the disclaimers, liability limits and dispute terms, will survive.
The Service is provided “AS IS”
To the fullest extent the law allows, the Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express or implied. That includes implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Service will be uninterrupted or error-free, that content will always be accurate or current, or that using it will lead to any result, including passing an exam. Some places do not allow these exclusions, so some of them may not apply to you.
Limit on our liability
To the fullest extent the law allows:
- we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, lost opportunities, or the cost of retaking an exam or delayed licensing; and
- our total liability to you for all claims about the Service is limited to the greater of (a) the amount you paid for the Service in the 12 months before the claim arose, or (b) US$100.
These limits do not apply where the law does not allow them, for example for fraud or for death or personal injury caused by negligence in places where that cannot be limited. Nothing here limits rights you have under mandatory consumer law where you live.
You agree to cover claims, losses and costs that come from your breach of these terms or your misuse of the Service, to the extent the law allows.
Disputes: talk to us first, then the courts
Please read this section carefully. It affects your legal rights.
- Talk to us first. Email support@swipeexam.com and describe the problem. Give us 30 days to try to resolve it.
- Courts. If we cannot resolve it, the dispute goes to the courts in Telangana, India, and you agree to their authority. If the law where you live gives you the right to bring your claim in your own local courts or consumer forum, you keep that right.
- Individual claims. To the extent the law allows, you and we may bring claims only on an individual basis, not as a member of a class or representative action.
Governing law. These terms are governed by the laws of India, without regard to conflict-of-law rules. This does not take away any mandatory consumer rights you have under the law of the place where you live.
Changes
We may update the Service and these terms. For material changes we will give at least 30 days’ notice in the app or by email. If you keep using the Service after a change takes effect, you accept it. If you do not agree, stop using the Service and cancel any subscription.
The rest
These terms, together with the Privacy Policy, are the whole agreement between you and us about the Service. If a part is unenforceable, the rest still applies. If we do not enforce something, we have not given up the right to later. You may not transfer your rights under these terms; we may transfer ours as part of a sale or reorganization. We are not responsible for delays or failures caused by events beyond our reasonable control. We may give legal notices by email or in the app. These terms are in English.
